These Terms of Service ("Terms") govern your access to and use of the website located at onesourcepool.com (the "Site") and any purchase you make through the Site, operated by One Source Pool, LLC ("One Source Pool," "we," "us," or "our"), located in New Port Richey, Florida. By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on the Site. By using the Site, you represent that you meet this requirement.

2. Products and Pricing

We make every effort to display product information, images, and pricing accurately. However, we do not warrant that product descriptions, images, pricing, or other content on the Site are accurate, complete, reliable, current, or error-free. In the event of a pricing or listing error, we reserve the right to cancel or refuse any order placed based on the error, and will notify you if this occurs.

All prices are listed in U.S. dollars and are subject to change without notice.

3. Orders and Payment

By placing an order, you represent that you are authorized to use the payment method provided and that the information you supply is accurate and complete. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or unavailability of stock.

4. Shipping

Shipping terms, timeframes, and costs are described in our Shipping Policy. We offer free ground shipping to the continental United States on all items. Shipments to Alaska, Hawaii, Puerto Rico, and international destinations may incur additional costs, which will be quoted prior to shipment.

Certain pool chemicals and other hazardous materials sold on the Site are subject to additional shipping restrictions described in Section 7 below, and may not be eligible for international or air shipment.

5. Returns and Refunds

Returns, exchanges, and refunds are governed by our Refund Policy. In general, items may be returned within 30 days of delivery for a full refund, subject to the conditions described in that policy, including the requirement to obtain a Return Merchandise Authorization (RMA) number before returning any item. Opened, used, or damaged chemical containers cannot be returned under any circumstances, as described further in Section 7.

6. Product Warranties

Products sold on the Site may be covered by a manufacturer's warranty. Any such warranty is provided solely by the product manufacturer, not by One Source Pool. We make no independent warranty regarding the merchantability, fitness for a particular purpose, or performance of any product beyond what is stated by the manufacturer. Please refer to the product's owner's manual for manufacturer warranty and service information.

7. Hazardous Materials and Pool Chemicals

The Site sells pool and spa chemicals (including but not limited to chlorine, bromine, muriatic acid, algaecides, oxidizers, and related water-treatment products) that are classified as hazardous materials and/or regulated substances under U.S. Department of Transportation (DOT), Environmental Protection Agency (EPA), and other federal, state, and local regulations. By purchasing these products, you acknowledge and agree to the following:

  • Age and legal capacity. You must be at least 18 years of age, or hold a valid license or permit where required by your jurisdiction, to purchase regulated pool chemicals.
  • Lawful use only. You will purchase, store, handle, use, and dispose of all chemical products in strict accordance with the manufacturer's label instructions, the Safety Data Sheet (SDS) available for the product, and all applicable federal, state, and local laws and regulations.
  • Shipping restrictions. Due to DOT and carrier hazardous-materials regulations, certain chemical products may be shipped only via ground transportation within the continental United States, may be subject to additional hazmat shipping fees, and may not be available for shipment to Alaska, Hawaii, Puerto Rico, P.O. boxes, or international addresses. We reserve the right to cancel or modify any order that cannot be lawfully shipped to the requested destination.
  • No returns on opened or used chemicals. For safety and regulatory reasons, chemical products that have been opened, used, or whose factory seal has been broken cannot be returned, exchanged, or refunded under any circumstances, regardless of the general Returns and Exchanges Policy. Unopened, sealed, undamaged chemical containers may be eligible for return subject to the standard Refund Policy and any applicable hazmat return-shipping limitations.
  • Storage and handling warning. Pool chemicals can be dangerous if mishandled, improperly stored, mixed with incompatible substances, or kept within reach of children, pets, or unauthorized persons. You are solely responsible for safe storage and handling after delivery. One Source Pool is not responsible for any injury, property damage, or loss resulting from improper storage, handling, mixing, or use of any chemical product after it has been delivered to you.
  • No medical or safety advice. Any product descriptions, usage suggestions, or dosage information provided on the Site are general in nature and do not replace the manufacturer's label instructions or SDS. Always read and follow the product label before use.
  • Commercial and public pool use. If you intend to use any chemical product in a commercial, public, or semi-public pool or spa setting, you are solely responsible for determining and complying with any additional licensing, certification, or regulatory requirements applicable to that use.

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of One Source Pool or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

9. User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.

10. Prohibited Conduct

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site or its related systems; (c) interfere with or disrupt the Site's operation; (d) submit false or misleading information; or (e) use any automated means to access or scrape the Site without our prior written permission.

11. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS SOLD THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN A MANUFACTURER'S WARRANTY.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ONE SOURCE POOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED THROUGH IT, INCLUDING ANY DAMAGES ARISING FROM THE STORAGE, HANDLING, MIXING, OR USE OF ANY CHEMICAL PRODUCT AFTER DELIVERY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE OR A PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless One Source Pool, its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your storage, handling, mixing, or use of any chemical product purchased through the Site.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Florida.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
